Terms & Conditions

1. For the care and safety of the other children at Head Start Day Nursery (“the Nursery”), entry may be refused on any day on which a child is infectious in any way and an exclusion policy exists for infectious conditions.

2. The Nursery Manager may withdraw the child from the Nursery in the event they consider the child to be disruptive or delinquent.

3. It is understood that under the provisions of the Children’s Act 1989 any carer who considers that a child in their care may have been abused or neglected has a duty to report this to Social Services.

4. Prior to the start date payment of the deposit is required and the first month’s fees by bankers order is payable on the start date. Head Start will not be obliged to admit the Child upon failure by the Parent(s) to pay deposit and fees by the start date or on any subsequent payment date.

5. Fees are payable monthly in advance by banker’s order, due on the 26th of the preceding month.

6. Non-payment of fees in advance or continued late arrival to collect a child may result in refusal to accept a child at the Nursery without notice.

7. Fees are subject to review annually in January.

8. In the event of non-attendance at the Nursery for illness, holiday (including Bank Holidays) or any other reason, the full fee is payable to retain the place.

9. Head Start will retain the Deposit if the parent(s) cancels the place within three months of the agreed start-date.

10. On termination of this Agreement, Head Start shall refund the Deposit to the parent(s) (without interest) after confirming that all Fees have been paid up to date; Head Start shall have the right to receive full payment during the notice period whether the Child attends the Nursery or not.

11. Six weeks written notice is required to terminate this Agreement, or to reduce attendance.

12. If this application is cancelled by the parent(s) within one month prior to the agreed starting date, Head Start will retain the deposit in its entirety.

13. Head Start accept no liability for any pecuniary or other loss suffered by the parent(s) arising directly or indirectly as a result of the Nursery being temporarily closed or the non-admittance of the Child to the Nursery for any reason.

14. It is understood that the parent(s) must keep the Nursery updated in writing in respect of any change in family contact details, ongoing illnesses, and allergies. Head Start cannot be held responsible for difficulties arising from any allergy of which it has not been advised.

15. It is understood that Head Start cannot be held responsible for any unlabelled clothing.

16. It is accepted and acknowledged that from the date of this Agreement and during its term and for six months after it terminates the parent(s) whose signature(s) appear overleaf will not (directly or indirectly) employ or retain the self employed or other services of any member of Head Start staff with whom the parent(s) or the child/children referred to in this Agreement have or have had contact/dealings without the prior consent in writing of Head Start. Should the parent(s) do so they will be required to reimburse to Head Start within 14 days of a request in writing for the same, a figure representing 50% of the relevant member of staff’s gross annual salary at the date of the termination of that staff member’s employment at Head Start.

17. It is understood that Head Start will on request apply its best endeavours to provide a place for a sibling of the child referred to in this Agreement but is under no obligation to do so or to give priority over children on any waiting list.

18. The parent(s) permit and hereby authorise, Head Start staff to arrange for the Child to receive medical treatment in case of emergency.

19. It is understood that terms and conditions may be varied by Head Start from time to time.
